MUY IMPORTANTE
The United Nations Commission on International Trade Law (UNCITRAL) approved the draft convention on negotiable cargo documents, recommending it for adoption by the United Nations General Assembly!
The new draft convention addresses a legal gap in international trade by establishing a harmonized legal framework for negotiable documents of title across all modes of transport—air, road, rail, and sea—regardless of the different modes of transportation used for the cargo.

United Nations Commission approves draft legislation on negotiable cargo documents
The UNCITRAL: United Nations Commission on International Trade Law has given its backing to approving draft legislation that extends negotiable cargo documents (NCDs) to all forms of transport.
Trade Finance Global (TFG) spoke to Jun XU, ICC Banking Commission, James Hookham, Global Shippers Forum, and Andrea Tang, FIATA International Federation of Freight Forwarders Associations, about the implications of this draft Convention gaining approval.
The new framework establishes harmonised legal provisions for negotiable documents of title across all modes of transport (that is, air, road, rail, and sea) regardless of how many different transportation methods are used for a single cargo shipment.
Beate Czerwenka, Chair of Working Group VI, said, “Thanks to the new draft convention on negotiable cargo documents, the vision of a world where trade is faster, safer and more accessible is becoming a reality.”

"Históricamente, los conocimientos de embarque se han utilizado ampliamente como documentos de título en el sector marítimo, mientras que los documentos de transporte emitidos por ferrocarril, carretera y aire (conocidos como “cartas de porte”), al ser típicamente no negociables, no podían ejercer esa función.
El nuevo instrumento define el “documento negociable de carga” como un título emitido y firmado por el transportista que incorpora derechos transferibles sobre las mercancías, equivalente funcional al conocimiento de embarque para cualquier modo de transporte, estableciendo un marco legal que otorga plena validez jurídica a los registros electrónicos negociables, garantizando su integridad, accesibilidad y control de posesión.
Al establecer un marco claro para el reconocimiento y uso de registros electrónicos negociables, garantiza su integridad, accesibilidad y control de posesión, lo que impulsa la definitiva transición de trámites en papel a entornos digitales. Esto se traduce en procesos logísticos más ágiles, menores costos y plazos, y en una mayor confianza de bancos y entidades financieras al aceptar estos instrumentos como garantía."

UNCITRAL Model Law on Automated Contracting
VIENNA, 15 July (UN Information Service) – The United Nations Commission on International Trade Law (UNCITRAL) adopted the UNCITRAL Model Law on Automated Contracting (the “Model Law”) at its 57th session in New York.
The Model Law provides a legal framework to enable the use of automation in international contracts, including through the deployment of artificial intelligence techniques and “smart contracts”, as well as in machine-to-machine transactions. It is intended to complement and supplement existing laws on electronic transactions, in particular those based on other UNCITRAL electronic commerce texts, which have been enacted in over one hundred jurisdictions worldwide. The Model Law is the first legislative text to result from exploratory work conducted by UNCITRAL on legal issues related to the digital economy and digital trade, with work on data contracts and distributed ledger technology ongoing.

The UNCITRAL/UNIDROIT Model Law on Warehouse Receipts was adopted by the United Nations Commission on International Trade Law (UNCITRAL) at its 57th session in New York yesterday!
The Model Law was developed as a joint project of UNCITRAL and UNIDROIT - International Institute for the Unification of Private Law.
The Model Law provides a legal framework that covers the private law aspects of a warehouse receipt system. The Model Law contemplates the issuance and transfer of both paper-based and electronic warehouse receipts on a medium-neutral and technology-neutral basis. This allows the use of central registries, distributed ledgers, platforms and other technologies for managing the electronic warehouse receipts.

As with all UNCITRAL and UNIDROIT #instruments, the Model Law is compatible with different legal and economic systems.
